Law schools have the authority to curb unlawful expression
The American Bar Association has passed a measure allowing law schools to restrict expression that violates the law, defames individuals, or constitutes a genuine threat or harassment. It’s time for all schools to use it.
The American Bar Association passed a measure in early February 2024 that allows law schools to restrict expression that violates the law, falsely defames specific individuals, or constitutes “a genuine threat or harassment.” This was after law firms had sent a letter to the deans of top law schools in the United States in early November 2023, encouraging condemnation of antisemitic harassment observed rising on campuses.
