Court: Bias Exists in Denial Of Job to Man Who Hid Past
Focus Column - By John J. Manier - Under a recent 9th U.S. Circuit Court of Appeals decision, an employer may violate the Americans with Disabilities Act, 42 U.S.C. Section 12101, et seq., by denying a job to someone with a record of past mental illness and violent criminal behavior - even if that person lied about his criminal history in his application for a position giving him unsupervised access to customers' homes. Josephs v. Pacific Bell , 432 F.3d 1006 (9th Cir. 2005).
