Proposition 64 Limits Use of Unfair-Competition Statute

Fellmeth - Policing unfair competition, including offenses, ranging from misleading advertising to privacy intrusion, depends upon state enforcement of the Unfair Competition Act (Business & Professions Code Section 17200 et seq). The federal counterpart to this statute is Section 5 of the Federal Trade Commission Act, but only the FTC is empowered to enforce that statute, and its authority and resources are weak.
