The Legislature of California has made it clear that courts generally are supposed to order either arbitration or mediation. California Code of Civil Procedure Section 1141.10, entitled "Legislative Purpose and Intent," states, "The legislature further finds and declares that arbitration has proven to be an efficient and equitable method for resolving small claims, and that courts should encourage or require the use of arbitration for such actions whenever possible."
