Global vs. Local

MOSK While the provisions specifically applicable to international arbitrations are codified in Code of Civil Procedure Sections 1297.11 et seq., the practitioner must first ascertain what is considered an "international" arbitration. Although each jurisdiction may have its own test, the two principal criteria used, either alone or together, to define the term "international" involve the nature of the dispute and the nationalities of the parties.
