Home health care workers assume the risk of injury, state high court rules

An in-home health care worker who suffered severe injuries at the hands of her elderly Alzheimer's patient cannot sue the patient or her husband, a divided state Supreme Court ruled Monday.

SAN FRANCISCO - An in-home health care worker who suffered severe injuries at the hands of her elderly Alzheimer's patient cannot sue the patient or her husband, a divided state Supreme Court ruled Monday.


The caregiver, Carolyn Gregory, knowingly assumed the risk of injury when she took the job, Justice Carol Corrigan wrote in the 5-2 ruling.
