Court: Insurance Companies Can Be Named Defendants

In a win for workers and their bosses, a 9th Circuit en banc panel held Wednesday that insurance companies can be named as defendants in federal lawsuits over employee benefits.

In a win for workers and their bosses, a 9th U.S. Circuit Court of Appeals en banc panel held Wednesday that insurance companies can be named as defendants in federal lawsuits over employee benefits.


The 11-0 decision by a circuit panel empowered to reverse circuit precedent expanded workers' rights under the federal Employee Retirement and Income Security Act, widely known as ERISA.
