SAN FRANCISCO - Reiterating his view that a trial is needed to resolve issues like whether sexual orientation is an immutable characteristic or whether the state has a legitimate interest in limiting marriage to opposite-sex couples, a San Francisco federal judge on Wednesday refused to toss a lawsuit challenging California's marriage laws.
