Justice Department asks for Supreme Court review of recess appointment challenges

The Department of Justice asked the U.S. Supreme Court Thursday to review an appellate court decision that would starkly limit the executive branch's ability to make recess appointments.

The Department of Justice asked the U.S. Supreme Court Thursday to review an appellate court decision that would starkly limit the executive branch's ability to make recess appointments. The case challenged appointments by President Barack Obama to the National Labor Relations Board, the beleaguered agency assigned to oversee union elections and decide labor disputes in the private sector.
