EPA recovery suits could be cut back

The Environmental Protection Agency's efforts to police the clean up of so-called "superfund" hazardous waste sites through cost recovery litigation could be curtailed due to sequestration and inter-agency liability issues.

The U.S. Environmental Protection Agency's efforts to police the cleanup of so-called Superfund hazardous waste sites through cost-recovery litigation has been integral in addressing some of the most polluted locations in the country. But some attorneys involved in the litigation believe the EPA - especially its westernmost region - could be hamstrung in bringing as many suits in the future.
