Court Cuts Judges' Role in Assessing Experts

LOS ANGELES - Judges may not assess the credibility of experts at probable cause hearings, an appellate court has ruled. Instead, the jury must make such determinations, the 2nd District Court of Appeal has found. Garcetti v. Superior Court (In re Marentez), 2000 Daily Journal D.A.R. 13273 (Cal. App. 2nd Dist. Dec. 14, 2000).
