Listservs Are Not Public Forums

Arash Homanpour writes in response to “Listserv Disclosure Was Proper, Paul Hastings Says," and Thomas O’Hagan reacts to “Rejecting Originalism,” by Erwin Chemerinsky.

LETTERS TO THE EDITOR COLUMN

As a frequent user of many plaintiff attorney listservs, I wanted to correct something quoted from Paul Hastings in the Jan. 25, "Listserv Disclosure Was Proper, Paul Hastings Says," article. Paul Hastings argues that California Employment Lawyers Association (CELA) member/plaintiff's attorney Stephen R. Jaffe "shared his writings with hundreds of strangers in the public forum of a listserv..." This is incorrect.
