Elians Father Is Not Legally Free to Speak

Shepherd The Immigration and Naturalization Service and the Justice Department base their view that Elian should be returned to Cuba on the principle that his father is the only person who can speak for him. They reason that because the father has said he wants Elian to return to Cuba, that is the end of the story. They all miss an important legal point.
