Change in Unfair-Competition Law Begs 'Causation' Question

Lovrien - The California Supreme Court has granted review in at least nine separate cases to determine whether changes made to California's unfair competition law and the false advertising law by Proposition 64 apply to cases pending at the time of passage. See Bivens v. Gallery Corp., 110 P.3d 1218 (2005). In all of these cases, the focus of the parties has been on the new injury-in-fact requirement.
