Don't Write Them Off
President Clinton's 2000 budget contains a long list of proposed tax increases for the millennium, including a particularly controversial change aimed at closing the loophole that allows companies to write off punitive damages as a business expense. Under the proposal, a defendant could no longer deduct punitive damages, whether paid as part of a settlement or after a judgment.
