Elder Abuse

Although enacted in 1982, California's elder abuse laws, Welfare and Institutions Code Sections 15600 et seq., have only recently spawned significant litigation. Lawsuits has skyrocketed in what health care providers and insurers see as an attempt by the plaintiffs' bar to avoid MICRA restraints on professional malpractice lawsuits, creating significant implications for health care providers, such as nursing homes, who are among the most common targets of elder abuse claims.
