A Judge Needs to Establish Openness, Fairness in Court
We should go much further than the required constitutional adequacy for voir dire about racial biases described by Laurie Levenson in her Feb. 26 article ("Bigot Busting," Forum). We are kidding ourselves if we do not realize that prejudice and bias play a role in many of our trials, both civil and criminal. The reality of the situation requires that judges be proactive and innovative while conducting voir dire.
