Prosecutors close criminal SAP case

Months after losing a civil trade secrets lawsuit to Oracle Corp., an SAP subsidiary agreed to plead guilty to 12 criminal copyright counts stemming from the same allegations. Was it an efficient prosecution, or too little too late?

When SAP subsidiary TomorrowNow Inc. agreed last week to plead guilty to 12 criminal counts stemming from infringement of Oracle Corp.'s copyrighted software, it appeared to be a win for Northern District prosecutors who have touted a crackdown on white collar and intellectual property crimes.


But the criminal allegations essentially copy those initiated by Oracle four years ago in a civil lawsuit...
