More ammunition for defeating class certification

On May 2, the 3rd U.S. Circuit Court of Appeals denied, by a 9-to-4 vote, a petition for rehearing en banc in Carrera v. Bayer, 727 F.3d 300 (3d Cir. 2013), a case which has already been highly cited and relied upon by district courts throughout the nation in denying class certification, and which will now very likely continue to garner support.
