California's competency rule is straightforward: An attorney cannot intentionally, recklessly or repeatedly fail to represent a client with competence. Rules of Prof. Conduct, Rule 3-110. Competence is defined to include diligence and skill, but it also includes the "mental, emotional and physical ability reasonably necessary" for the representation. Rules of Prof. Conduct, Rule (B)(3).
