Transgender restroom case could affect agency deference

Last month, the U.S. Supreme Court agreed to hear Gloucester County School Board v. G.G. ex rel. Grimm. This case considers whether Title IX requires schools to provide transgender students access to restrooms corresponding to their gender identity. More broadly, the Supreme Court's decision may determine whether courts owe deference to federal agencies' interpretations of their own regulations.
