A lawsuit filed this week alleging Los Angeles County's new charge on paper carry-out bags is unconstitutional is among the first to invoke Proposition 26, which limits government authority to raise taxes.


The complaint, filed in Los Angeles County Superior Court, calls the charge a special tax and argues that the measure violates Prop. 26 because the county never sought voter approval of the charge....
