Purpose of Workers' Comp Award Is Crucial in Divorce

Focus Column - Family Law - By Mitchell A. Jacobs and Robert Burch - In a case of first impression, Raphael v. Bloomfield 113 Cal.App.4th 617 (Cal. App. 2nd Dist. 2003) held that a lump sum workers' compensation award received before separation was the separate property of the injured spouse to the extent it was meant to compensate for the injured spouse's diminished earning capacity and medical expenses after separation.
