Panel wipes out sanctions in suit over FBI surveillance

The 9th Circuit panel reversed U.S. District Judge Cormac J. Carney's judgment awarding plaintiffs' attorneys $36,248 in sanctions in a case brought on behalf of the Islamic Shura Council of Southern California and several other parties.

A federal appellate panel Wednesday overturned a lower court in a closely-watched lawsuit involving the FBI's surveillance of Islamic communities, wiping out sanctions against the government for withholding information at the outset of the case.
