Court Rejects Trespassing Theory of E-Mail
SAN JOSE - In a legal battle that pitted freedom of speech against a company's private property rights, a divided California Supreme Court ruled Monday that Intel Corp. cannot use tort law to prevent a former employee from sending unwanted messages through its e-mail system.
