Ashcroft Immune from Suit

The U.S. Supreme Court unanimously ruled Tuesday that former Attorney General John D. Ashcroft is immune from a civil suit claiming he used the material witness statute as a pretext to detain a U.S. citizen.


The U.S. Supreme Court unanimously ruled Tuesday that former Attorney General John D. Ashcroft is immune from a civil suit claiming he used the material witness statute as a pretext to detain a U.S. citizen.


The 8-0 judgment is the second time the court overturned the 9th U.S. Circuit Court of Appeals to insulate the former attorney general from legal liability. Justice Elena Kagan was recused. Ashcroft v. al-Kidd, 10-98.
