Justifying an Unbecoming

The 9th Circuit's recent reversal of the death sentence previously affirmed by the California Supreme Court and the federal district court in David Murtishaw's case speaks volumes about the death penalty. While DNA and reform are being touted as solutions to the problems with capital punishment, Murtishaw's case shows that there are no legislative or scientific solutions to human error, no matter how well-intentioned or, as in the case of the California Supreme and and federal district courts, no matter how well-reasoned.
