SPECIAL ISSUE: CORPORATE LAW By Barry Landsberg and Harvey Rochman The California Supreme Court held recently that fluid recovery is not available in representative actions under California's unfair competition law, Business and Professions Code Section 17200, et seq. , and that unpaid wages can provide a basis for restitution to employees. The court declined, however, to rule on whether any award of restitution to nonparties in unfair competition law cases violates defendants' due process rights.
