Weinstein of the U.S. District Court for the Eastern District of New York approved the application of market-share liability to firearm manufacturers. As a result, nine of 15 defendants were found to have caused injury to one or more shooting victims. Hamilton v. Accu-tek, 62 F. Supp.2d 802 (E.D.N.Y. 1999). Market-share liability was applied to make up for the fact that the manufacturers of the weapons used in the shootings were unknown - the guns used in the shootings were never found.
