Appeals court rules water users must notify state officials when planning substantial water diversions

In a unanimous reversal of a Siskiyou County Superior Court ruling, the appellate court held that state law clearly gives the wildlife agency the authority to seek out such information as part of its duty to protect the state's fish.

In a decision that could increase the amount of water flowing in the state's streams and rivers to help salmon and other fish, the 3rd District Court of Appeal on Thursday ruled that farmers and other water users must notify the state Department of Fish and Wildlife if they plan to divert substantial amounts of water.
