The U.S. Supreme Court reinstated a decade-old consumer class action against Bayer Corp. in West Virginia state court with its unanimous decision Thursday.
The justices ruled that a federal judge did not have the authority to block a state court's consideration of class certification in the case, overturning the 8th U.S. Circuit Court of Appeals. Smith v. Bayer, 09-1205.
