Blanket Rule

Anderson, 12 Cal.App.4th 345 (1995), the court addressed the traditional area of deed restrictions, equitable servitudes and covenants, conditions and restrictions (CC&Rs). The court held that if a subdivider recorded a declaration establishing a common plan in a subdivision containing restrictions on the use of property, it would be enforceable whether or not it was "additionally cited: in the deed or contract with the purchaser.
