The U.S. Supreme Court's decision last week in POM Wonderful Inc. v. Coca-Cola, 2014 DJDAR 7436 (June 12, 2014), looks at first blush like a win for consumers: POM Wonderful can proceed with claims that in marketing its so-called pomegranate-blueberry juice blend - which contained considerably less than 1 percent pomegranate and blueberry juice - Coca-Cola deceived consumers.
