Attorney error should not cost client a chance to avoid restitution, court rules

A criminal defendant should not be harmed by his attorney's mistake, an appellate court has ruled, giving a convicted murderer a second chance to avoid paying $105,000 in restitution.

A criminal defendant should not be harmed by his attorney's mistake, an appellate court has ruled, giving a convicted murderer a second chance to avoid paying $105,000 in restitution.


Defendant Marlon Rivera was sentenced to 35 years to life and ordered to pay almost $25,000 to the Victims Compensation and Government Claims Board and $80,000 to two victims.
