Moving Matters in Custody

Forum Column - By Gloria Allred and Michael Maroko - In 1996, the state Supreme Court in In Re Marriage of Burgess , 13 Cal.4th 25 (Cal. 1966), set forth new standards and guidelines to determine whether a parent seeking to relocate after dissolution of marriage has a burden of establishing that the move is necessary and whether the custodial parent has a right to change the residence of the child absent a showing the move away would prejudice the rights or welfare of the child.
