Though it's understandable legislators want to protect homeowners from predators, two proposed bills would throw the baby out with the bathwater, writes Jonathan Stein.

Newspapers, consumer groups and even the State Bar are coming out in favor of SB 94 and AB 764. These bills are similar in their scope. Both make it a crime for anyone to take money up front to assist a homeowner where the end result is a loan modification. Both bills criminalize the exchange of money, even if the money goes into a trust account.
