High court to weigh attorney fees for wage and hour litigation

The state Supreme Court will hear oral argument this week to determine whether employers can recover some of their attorney fees in wage-and-hour litigation.

SAN FRANCISCO - When a state appellate court ordered workers to partially reimburse their employer for money spent fighting a wage-and-hour suit two years ago, employment defense lawyers touted the win.


In client alerts and blogs, attorneys put out the word that employers could use the threat of a big attorney fee award to discourage workers from bringing unmeritorious or weak wage-and-hour cases.
