First Kagan Opinion Constrains Debtors

WASHINGTON - In the first judicial opinion written by Justice Elena Kagan at any level, the U.S. Supreme Court held Tuesday that debtors in personal bankruptcies can't take car ownership deductions if they're not making car payments.


The decision, which affirms a 9th U.S. Circuit Court of Appeals ruling, clarifies a section of the Chapter 13 bankruptcy rules that Congress reformed in 2005. ...
