Novel damages theory clears 9th Circuit in environmental case

A novel theory of recovery - for "intangible environmental damages" - emerged from the embers of a destructive wildfire in a case decided Friday by a 9th U.S. Circuit Court of Appeals panel.


It's not enough for contractors who caused the huge 2002 Copper Fire in Angeles National Forest to pay $7.6 million in firefighting and mitigation costs, the panel held.
