Medical device companies hoping to tie up a competitor's products in federal court may now have to rely on new legal tactics.
A 9th U.S. Circuit Court of Appeal ruling published Wednesday upheld the supremacy of federal regulators to intervene in device cases, and found private litigants do not have standing to enforce the Food, Drug and Cosmetic Act.
