Employment Relationship Clarified in Unpaid Wage Claims

The state Supreme Court sheds light on the employment relationship between produce merchants, growers and farm laborers, writes Frances Rogers of Liebert Cassidy Whitmore.

The California Supreme Court recently clarified the deference to be given to wage orders issued by the Industrial Wage Commission ("IWC"). In doing so, it found that there was no "joint employer" relationship between produce merchants and a grower for the unpaid wages of seasonal farm laborers.
