Effective last Oct. 1, the federal Electronic Signatures and Global and National Commerce Act, 15 U.S.C. Section 7001 et seq., gives presumptive validity to electronic transactions and "e-signatures." The act provides that a court cannot refuse to enforce a transaction in or affecting interstate or foreign commerce solely because it was signed or maintained electronically. The law requires certain consumer disclosures and consent, and pre-empts inconsistent state laws.
