Death Sentence Withstands Juror Misconduct Claims

A divided federal appeals court on Monday turned away explosive claims of juror misconduct and upheld a 1979 death sentence for multiple rapes and robberies and the murder of a University of Southern California student.The 9-6 en banc ruling by the 9th U.S. Circuit Court of Appeals turned on the issue of whether a juror's impartiality was compromised when his wife, a rape victim, confided in him during trial that she suspected the defendant was her attacker.
