Fair Hearing

The court held that a council member can appeal if authorized by the local code as long as due process is not violated.

        In a recent decision, the court stated that a councilperson could file with the city council an appeal of a planning commission's approval of a conditional-use permit and could participate in the final decisionmaking. BreakZone Billiards v. City of Torrance, 81 Cal.App.4th 1205 (2000).
