Case may make it easier to beat anti-SLAPP motions

A recent decision may permit plaintiffs to defeat these motions by using vague, generically pleaded complaints.

California's anti-SLAPP statute (Code of Civil Procedure Section 425.16) permits early dismissal of frivolous claims filed to interfere with the exercise of the constitutional rights of freedom of speech and petition for the redress of grievances so that defendants are "not ... dragged through the courts" as the result of exercising constitutional rights. People ex rel. Lockyer v. Brar, 115 Cal. App. 4th 1315, 1317 (2004).
