In reversal, 9th Circuit denies immunity to officer who killed woman who stole car

In a rare reversal in a wrongful death case, a 9th U.S. Circuit Court of Appeals panel on Wednesday denied immunity to a California Highway Patrol officer who shot and killed a woman in a stolen car in San Francisco after a chase.

In a rare reversal in a wrongful death case, a 9th U.S. Circuit Court of Appeals panel on Wednesday denied immunity to a California Highway Patrol officer who shot and killed a woman in a stolen car in San Francisco at the end of a high speed chase.


In 2011, the panel took the contrary view - that CHP Officer Stephen Markgraf was immune from a suit by the woman's surviving children.
