Federal Judge Upholds DNA Collection as Condition of Bail

For defendants, giving a DNA sample is no different from providing a fingerprint or posing for a booking photo, a federal judge has ruled.

For defendants, giving a DNA sample is no different from providing a fingerprint or posing for a booking photo, a federal judge has ruled.

Prosecutors are hailing the decision as the first to uphold a federal law allowing collection of DNA evidence from defendants before conviction - contradicting other courts in what appears likely to be an on-going controversy.
