Retiree health care cuts OK, appeals court rules

The decision says health insurance is not a constitutionally protected benefit for the employees like a pension is, based on the city's charter, which allowed the city to make the change without consulting employees.

Health care is not a vested right for San Diego's retired public employees, a California Court of Appeal panel ruled last week, joining a chorus of jurists who have said that the city acted within the law when it froze annual health care payouts to police officers in 2009.
