Platters member loses trademark fight over band name

In a case of first impression, the 9th Circuit deems the 'possibility' of irreparable harm insufficient for a preliminary injunction over the use of a trademark.

The well-known 1950s vocal group The Platters is headed back to a Nevada court after the 9th U.S. Circuit Court of Appeals on Monday overturned a lower court's ruling granting a preliminary injunction in favor of the estate of band member Herb Reed, naming the estate the sole trademark holder for The Platters name.
