Religious groups grapple with land use protections

RLUIPA cases, based on substantial burden claims, have increased recently, despite the fact that many cities are being more careful about enacting ordinances that discriminate against religious organizations.

When Glory Tabernacle Christian Center purchased property in Bellflower, the city imposed parking requirements that church leaders felt were onerous and discriminatory. The center filed a lawsuit under the Religious Land Use and Institutionalized Persons Act, or RLUIPA, a little known law that allows religious organizations to fight perceived discrimination in zoning laws.
